摘 要:为了能够更好地处理和解决消费者在网络上发生的购物纠纷问题,保护消费者权益,消费者撤回权已被写入《消费者权益保护法》。然而由于购物网的错综复杂,网购商品的多样性,许多商品难以保存或保值代价太高等因素都会影响消费者撤回权的使用。想要通过一部刚实施的法律在短期内达到预期的目标难度很大。撤回权与一些相关权利难以区分,人们对于这个新权利的了解和运用得不够多,对于7天无理由的计算时间也存在争议。文章将通过对消费者撤回权的概念、行使方式、运用情景等方面进行分析,将撤回权与其他相关权利进行对比明确它的适用情形,提高该权利的知识普及。并且对于撤回权的一些细则加以补充的建议以及7天无理由的具体时间规定提出建议,以促进我国网上消费活动的健康、有序发展。In order to better handle and resolve consumers'online shopping disputes and protect consumers'rights and interests,Consumers'Right of Withdrawal has been written into the Law on the Protection of Consumer Rights and Interests.However,such factors as the complexity of shopping network,the diversity of online products,the difficulty in preserving products and the high cost of maintaining value will all affect the use of Consumers'Right of Withdrawal.With a newly implemented law,it is very difficult to achieve the desired goal in the short term.It's hard to distinguish the Right of Withdrawal from other related rights.People do not understand and exercise this new right enough.And there is debate about the time frame in the 7 Day Return Policy.This article will analyze the concept,exercising method and application scenarios of Consumers'Right of Withdrawal,and compare it with other related rights to clarify its applicable situation and popularize the knowledge about it.In addition,the article will propose some suggestions for supplementing the detailed rules of the Right of Withdrawal and setting the time frame in the 7 Day Return Policy to promote the healthy and orderly development of online consumption.
