摘　　要：现阶段网络短视频行业发展迅猛,随着网络短视频数量的不断增多,相关侵权案件的数量也在不断攀升,侵权类型主要表现为对署名权、保护作品完整权及信息网络传播权等的侵犯。目前,网络短视频“独创性”标准不明、网络平台责任缺位、权利救济成本偏高等,是网络短视频版权保护面临的突出问题。建议采取相应措施明确网络短视频“独创性”标准、填补平台责任漏洞、降低权利救济成本,进一步保障网络短视频权利人的利益,促进网络短视频产业的健康发展。At the present stage,the network short video industry is developing rapidly.With the increasing number of network short video,the number of relevant infringement cases is also increasing,the infringement types are mainly manifested as the infringement of the right of authorship,the right to protect the integrity of works and the right to disseminate information online.At present,the outstanding problems in the copyright protection of network short video are unclear standard of"originality",lack of responsibility of network platform and high cost of right relief.The"originality"standard of network short video is unclear,which is manifested in the lack of a general definition of audio-visual works and a detailed standard for judging"originality".The absence of responsibility of network platform is manifested in unclear responsibility norms,lack of active review responsibility and imperfect tort review mechanism.The high cost of right relief shows that the infringement is not easy to detect and the rules of litigation proof are not perfect.It is suggested that corresponding measures should be taken to clarify the"originality"standard of network short video,fill the liability loophole of network platform,reduce the cost of right relief,further protect the interests of the right holder of network short video,and promote the healthy development of network short video industry.Specifically,to clarify the"originality"standard of network short video,we need to make a general definition of audio-visual works and refine the judgment standard of"originality";to fill the responsibility loopholes of network platform,we need to further improve the responsibility specification of the network platform,establish the principle of"Beyond the Red Flag Standard"and improve the review mechanism of network short video content;to reduce the cost of right relief,we need to give full play to the significant advantages of technical measures and reshape the system of burden of proof in litigation.
