摘 要:生态环境损害赔偿磋商蕴含着平等自愿协商的私法理念,赔偿权利人及其指定的生态环境保护部门作为磋商主体,同时具有行政公权力与生态环境损害索赔的私权利,应当建构磋商程序中的监督机制,通过程序正义保障磋商内容的公平公正。通过加强政府监督、提高公众参与的积极性以及明确第三方组织介入监督等手段,建立健全生态损害赔偿磋商程序中的监督机制,保障磋商的效率与正义,提升生态环境修复的效能,最大限度发挥磋商机制的应有作用。The consultation on ecological damage compensation contains the concept of private law of equal and voluntary consultation.As the main body of the consultation,the compensation obligee and its designated ecological protection department have the administrative public power and ecological damage claim private right at the same time.The supervision mechanism in the consultation procedure should be constructed to ensure the fairness and justice through procedural justice.By strengthening government supervision,improving the public participation and clarifying the involvement of third-party organizations in supervision,the supervision mechanism in the consultation process of ecological damage compensation is established consolidation to ensure the efficiency and justice of consultation,improve the efficiency of ecological restoration,and maximize the role of the consultation mechanism.
