依法治校视阈下高校法律关系的反思、平衡与重构——从湖南省高校校内制度谈起

摘　　要：我国自2003年首次提出"依法治校"以来,高校治理的法治建设不断深入探索,在章程制定、学生管理、学术规范等领域勾勒了自主管理的基本法律框架。通过对湖南省内部分高校校内制度的梳理,发现当前的高校治理仍存在党政衔接不畅、学术自治失范、章程地位落空、权利保障不力等四个方面的问题。高校校内制度的规范化不仅在静态层面需加强权力控制和强化权利,还需在动态层面体现法治思维和民主逻辑。故此,重构校内制度应在组织法体现配权合理、在权利法上体现权利保障、在程序法上体现程序正义,方能在高校自主管理全环节实现依法治理。Since the"the school governance by law"was first proposed in 2003,the construction of the rule of law in university governance has been further explored,outlining the basic legal framework of independent management in the areas of constitution formulation,student management,academic norms and so on.Through sorting out the internal system of colleges and universities in Hunan Province,there are still institutional bottlenecks in the current governance of colleges and universities from four aspects:the poor connection between the party and the government,the anomie of academic autonomy,the failure of the status of the articles of association,and the poor protection of rights.The standardization of internal system of school not only strengthens the control of power and the right at the static level,but also reflects the thinking of rule of law and democratic logic at the dynamic level.Therefore,the reconstruction of the internal system of school should reflect the rational allocation of rights in the organizational law,the protection of rights in the rights law and the procedural justice in the procedural law,so as to realize the governance according to law in the whole link of independent management of colleges and universities.
