摘 要:《法律援助法》首次对法律援助经费问题进行了立法规制:一是明确法援经费纳入县级以上政府财政预算,二是对于为法律援助制度提供支持的个人与单位进行鼓励,三是规定了法律援助补贴及其标准。然而上述规定仍然具有一定的原则性、总体性,对目前我国法援经费领域存在的总量不足、办案经费比例较低、经费分配地域不平衡等问题,并未提供制度性的细化规范。未来法律援助立法应构建具有中国特色的法律援助经费管理体系,并建立多元化的法律援助经费给付制度。Legal Aid Law provides the legislative regulations on legal aid funds for the first time:firstly,it confirms that legal aid funds shall be incorporated into the fiscal budget of governments above the county level;secondly,individuals or organizations who offer support for the legal aid system shall be encouraged;and thirdly,legal aid subsidies and their standards are stipulated.Although the regulations mentioned above have some principles and general provisions,they don’t provide institutional detailed specifications on current problems of legal aid funds in China such as inadequate supply,low proportion in funds for handling cases,and geographical imbalance in appropriation allotment.Future legal aid legislation shall establish a management system of legal aid funds with Chinese characteristics,and create a diversified payment system of legal aid funds.
