身份视角下土地承包经营权的现实问题与对策

摘　　要：汉语语境中身份通常指个体的出身、社会地位或资格,身份不仅是个体在社会生活中的角色划分,也是开展社会生活的最基本元素。社会复杂性以及人的社会属性共同决定了通过身份获取特定权益的可能和必然。通过研究妇女身份下的土地承包经营权和新生人口的土地承包经营权的现状解构农民身份的内在价值,通过调整承包时间变更村集体管理模式等措施来解决农民现实难题。Identity in the Chinese context usually refers to the origin,social status or qualifications of an individual.Identity is not only the division of an individual’s role in social life,but also the most basic element of social life.The complexity of society and the social attributes of people together determine the possibility and inevitability of obtaining specific rights and interests through identity.The land contractual management rights discussed in this article are due to the characteristic rights structured by the unique land ownership system in our country.The article deconstructs the intrinsic value of farmers’identity by studying the status quo of women’s land contract management rights and the new population’s land contract management rights,and solves the practical problems of farmers by adjusting the contracting time and changing the village collective management mode.
