摘　　要：习近平法治思想坚持以人民立场为要旨,引领法治建设各环节表达对人民的充分尊重。在推动法治建设重心由依法而治到良法善治,由形式正义到实质正义,由秩序本位向和谐秩序的嬗变过程中,刑事法治建设的发展方向也发生相应调整。在理念维度,根据人民现实需求逐步树立以预防型立法、裁量型司法、宽缓型治理为价值取向的刑事法治理念;在实践维度,通过积极修正与增设规范以回应人民社会关切、稳步推进刑事司法体制改革以满足人民公正诉求、塑造和谐犯罪治理模式以实现人民自由憧憬。最终破解刑事法治建设制约瓶颈,推动刑事法治建设达到时代新高度,构建起具有中国特色的刑事法治新格局。Xi Jinping’s thought on the rule of law insists on taking the people’s stand as its main thrust,leading all links in the construction of the rule of law to express full respect for the people.As the focus of promoting the construction of the rule of law is shifting from rule by law to good rule by law,from formal justice to substantive justice,and from order-based to harmonious order,the development direction of criminal rule of law has also been adjusted accordingly.On the conceptual dimension,gradually establish the concept of criminal rule of law with the value orientation of preventive legislation,discretionary justice,and lenient governance;on the practical dimension,actively modify and add norms to respond to the people’s social concerns and steadily advance the reform of the criminal justice system.Satisfy the people’s justice demands and shape a harmonious crime governance model to realize the people’s vision of freedom.Finally,it will break the bottleneck of the construction of criminal rule of law,promote the rule of criminal law to the new height of the times,and build a new pattern of criminal rule of law with Chinese characteristics.
