摘 要:在国家政策导向和实践推动下,整体系统保护因符合生物多样性保护的科学机理、功能关联性、多元化利益平衡等要求,开始成为我国生物多样性保护法治体系建设的重要内容。在法治视野下,生物多样性整体系统保护不仅具有保护目标整体性、法律规制手段多样性、保护主体协同性等法理基础,而且在生物多样性跨境保护、流域性生态环境保护、自然保护地整体性保护等方面已有充分的法治实践。立足于生物多样性整体性保护的意涵和现有法治基础,今后可从法律规范体系、行政监管体制、科学评估机制、公私协同的保护模式等角度为实现生物多样性法律规制范式向整体系统转变提供路径保障。Driven by national policy guidance and practice,the overall system of biodiversity conservation has become an important part of the efforts to establish a legal system of biodiversity conservation in China because it meets the requirements of scientific mechanism,functional relevance and balance of diversified interests needed in biodiversity conservation.From the perspective of rule of law,the overall system of biodiversity conservation not only has the legal basis including the integrity of conservation objectives,the diversity of legal regulation means and the coordination of conservation participants,but also has sufficient legal practice in the cross-border biodiversity conservation,the protection of watershed ecological environment and the overall protection of nature reserves.Based on the meaning of overall biodiversity conservation and the existing legal basis,this article proposes to provide a path guarantee for the transformation of biodiversity legal regulation paradigm to the overall approach from the perspective of the legal regulation system,administrative supervision system,scientific evaluation mechanism and public-private collaborative conservation model in the future.
