浅析欧盟拟出台《机械产品条例》与现行《机械指令》的区别

摘　　要：现行《机械指令》2006/42/EC是欧盟针对危险机械和通用机械制定相关基本健康和安全要求的对所有成员国具有法律整体约束力的技术文件,该指令同样适用于出口到欧盟的机械。为了加强人工智能集成机械产品的安全性,欧盟拟出台《机械产品条例》替代现行《机械指令》,这势必对以欧盟市场为主的我国机械制造企业造成一定的影响。我国相关部门、行业组织和企业应对拟出台的《机械产品条例》开展研究,及时制定和调整策略,以积极应对欧盟政策和市场的新变化。The existing Machinery Directive 2006/42/EC is a technical document legally binding on all Member States for EU to formulate relevant essential health and safety requirements for hazardous and general machinery. The directive is also applicable to machinery exported to the EU. In order to enhance the safety of machinery products integrating artificial intelligence, the EU proposes to issue a regulation on machinery products to replace the existing Machinery Directive, which is bound to have an impact on China’s machinery manufacturing enterprises dominated by the EU market. The relevant authorities, industry organizations and enterprises shall study the proposed regulation on machinery products and develop and adjust strategies in time to actively respond to the new changes in EU policies and markets.
