核损害赔偿责任公约法律体系下运营者场内财产的除外责任初探

摘　　要：就核损害赔偿责任的除外责任,一般而言国际公约及国内法均规定了战争、武装冲突、受害人故意等情形,个别公约提及了巨大自然灾害,然而,鲜有公约或国内法对发生核事故的核设施的边界进行详细探讨,也因此在实践中核设施的场内财产边界划分产生诸多问题。本文旨在通过对国际公约及其磋商文件的分析,为运营者的场内财产除外责任的边界进行探讨,并通过对各国相关国内法的借鉴,为解决实践中的问题提出相应结论和参考。As regard to the excluded liability of the nuclear liability,in general,international conventions and relevant national laws have the scenarios of war,armed conflicts,victim’s intentional act,etc.,only a few scenarios stipulated grave natural disaster.However,there are rare circumstances discussed about the exclusion of the boundary of the operators’on-site property.Following the situation,the practices raised up several problems.This article aimed at analysis of international conventions and their negotiation records,so as to discuss the exclusion of the boundary of the operators’on-site property,and to provide a comparative conclusion and reference to the practice,according to the study on national laws,.
