摘　　要：权利范式是真正掌握“马克思与正义”难题的实质向度,洛克劳动自我所有权原则是支撑自由主义正义叙事的“理论根基”。马克思基于唯物史观范式的劳动理论,从“现实的人”的劳动实践出发,通过对自由主义正义叙事之根基的前提批判而深入生产领域,揭示作为自由主义制度载体的资本主义生产方式的性质和本质——以生产剩余价值和资本增殖为目标的“资本正义”,从而根本性地对资本主义及其正义叙事进行了批判;同时,在对生产方式或所有制进行根本和前提性的变革中,历史辩证地构建了超越资本主义及其自由主义意识形态正义叙事的科学社会主义劳动权利原则——以人的生存发展和自由解放为目标的“劳动正义”。Right paradigm is the essential dimension to truly grasp the problem of“Marx and justice”,and Locke’s principle of labor self-ownership is the“theoretical foundation”to support the justice narrative of liberalism.Based on the labor theory of historical materialism paradigm,Marx proceeded from the labor practice of“real people”,penetrated into the field of production through the criticism of the premise of the foundation of liberal justice narrative,and revealed the nature of the capitalist mode of production as the carrier of the liberal system and essence-“capital justice”aiming at producing surplus value and capital multiplication,thus fundamentally criticizing capitalism and its justice narrative.At the same time,in the process of the fundamental and prerequisite reform of the mode of production or ownership,Marx history dialectically constructed the principle of scientific socialist labor rights that transcends the justice narrative of capitalism and its liberal ideology-the“labor justice”aiming at the survival,development and liberation of human beings.
