摘　　要：陪审团隔离制度是一个在中国学术界无人介绍的冷知识,它起源于1770年,现在适用比例占所有刑事案件的1%以下。陪审团隔离制度的预设功能有:阻却媒体的偏见性报道、减少亲友和民众的影响和干扰、保证陪审员人身安全、通过形式正义增强司法公信力。陪审团隔离促进公正的功能也存在局限,主要表现在:在隔离状态下,容易形成陪审员仓促审判、附和裁决、情绪化裁决,陪审员在隔离前或配偶探访中会受到信息污染,法院会在审判中限制正当程序以减轻管理负担。同时,陪审团隔离制度还会存在衍生问题。因此,陪审员隔离只能有限适用,且需要付出更大的成本,以使隔离措施更加人性化。Sequestered jury system is a cold knowledge that has not been introduced in Chinese academic circles.It originated in 1770 and now accounts for less than 1% of all criminal cases.The pre-set functions of the sequestered jury system include:preventing the biased reports of the media,reducing the influence and interference of relatives,friends and the public,ensuring the personal safety of jurors,and enhancing the judicial credibility through formal justice.The function of sequestered jury to promote justice is also limited,which is mainly manifested in the following aspects:in the isolation state,it is easy to form the jury’s hasty trial,supplementary verdict and emotional verdict,the jury will be polluted by information before isolation or during the visit of spouse,and the court will restrict due process in the trial to reduce the burden of management.At the same time,there will be derivative problems in sequestered jury system.Therefore,sequestered jury can only be applied in a limited way,and it needs to pay a greater cost,more humane isolation measures should be taken.
