环境法典编纂方法论:可持续发展价值目标及其实现

摘　　要：环境法典编纂的方法要义在于确立可持续发展为法典价值目标,重塑与之契合的生态环境基石概念并构建环境法律关系,将可持续发展确定的价值体系外化为环境法典的调整范围与规范构造。生态环境概念兼具宪法依据与实践趋向,予以界定后有助于走出立法保护对象的概念困境,经与可持续发展耦合性重释后,在环境法典中明确污染控制、自然生态保护与绿色低碳发展的类型化调整范围。环境法典编纂还需将环境与发展综合决策方法通过法律关系构造进行规范转化,通过重构环境法律关系,建立"权力—职责""权利—义务"立体结构,将可持续发展目的价值与生态安全、环境公平、公益保障等工具价值予以具体展开。The methodological essentials of environmental codification lie in establishing sustainable development as the value orientation of the code, reshaping the corresponding concept of ecological environment and constructing the environmental legal relations, thereby externalizing the value system determined by sustainable development into the regulation scope and the structure of legal norms of the environmental code. The concept of ecological environment conforms to constitutional basis and the trend of practice, and to define it is conducive to out of the conceptual dilemma of legislative protection object. Reinterpretation of this concept coupling with sustainable development, the categorized regulation scope of pollution control, natural ecological protection as well as green and low-carbon development could be clarified in the environmental code. The codification of environmental law also requires the normative transformation of the method of integration of environment and development in decision-making through the construction of legal relations. By establishing a three-dimensional structure of "power-duty" and "right-obligation" for environmental legal relations, the purpose value of sustainable development and the instrumental value of ecological security, environmental equity, public interest protection are specifically developed.
