循环利用机制纳入环境法典探索:理念、体系与制度构成

摘　　要：可持续发展的理念追求与扎实的实证法基础共同达成了循环利用机制纳入环境法典的条件成熟,安置于绿色低碳发展编则是其体系理念与体系效益的集中呈现。在典内制度构成方面,以可持续发展为目的价值和逻辑主线,构建环境法典框架;通过重组规则,固定现行法的成熟制度,确立基本规范体系;拓展循环利用的标准之治,推动法律责任脱虚入实。在典外制度构成及衔接方面,不宜直接规定循环利用的概念,保留与相关环境单行法的更多接口;应突出衔接条款的特殊配置,定向联通标准化法律法规,扩大循环利用外部体系的可能范围。The pursuit of the concept of sustainable development and a solid empirical legal basis have reached a mature condition for the cyclic utilization mechanism to be included in the environmental code.Placement in the green and low-carbon development section is the centralized presentation of its system concept and benefits. Regarding the institutional structure of the environmental code, the goal value and logical main line of sustainable development are to construct the framework of the environmental code.Through reorganization rules, the mature system of the current law can be fixed, the basic normative system can be established, the governance role of cyclic utilization standards can be expanded and the strengthening of legal responsibilities can be promoted. Regarding the composition and connection of systems outside the environmental code, it is not appropriate to directly stipulate the concept of cyclic utilization, but to retain more interfaces with relevant environmental separate laws, and highlight the special configuration of connection clauses, directionally link standardization laws and regulations, and expand the possible scope of cyclic utilization external systems.
