党内法规研究中的概念:内涵辨析、体系构建与重要价值

摘　　要：党内法规研究逐年趋热,但相关概念仍存在混用现象,亟待辨析。“党内法规”应按照规定性意义来使用;“党内法规体系”是规定性意义的党内法规所构成的规范文本的结构体系;“党内法规制度”则应理解为包括规范性文件、组织机制和不成文规范制度在内的概念。基于以上,“党内法规制度体系”概念旨在强调横向领域和纵向层级的体系化划分,由此引出统领“党内法规制度体系”等并列概念的“党内法治体系”概念。把握“党内法治体系”,便能构建相关概念的逻辑体系,有利于推动党内法规学科成熟、加快多学科对话场域建设及构建中国特色哲学社会科学话语体系。Inner Party Regulation study has become a hot spot in recent years,yet some concepts are still in a mess and need to be discriminated and identified.The concept of“Inner Party Regulation”should be used in academic research in accordance with the prescriptive meaning;“The system of Inner Party Regulations”is the structure system of a static normative text composed of Inner Party Regulations in prescriptive meaning;“The Institution of Inner Party Regulation”is a concept covering normative documents,organizational mechanisms and unwritten normative systems.Based on this,the concept of“The institutional system of Inner Party Regulation”emphasizes the systematic division of horizontal domain and vertical level,and then leads to the concept of“Inner Party Legal System”which serves as the upper concept of the concept of“the institutional system of Inner Party Regulation”and its parallel concepts.A thorough understanding of“Inner Party Legal System”can then lead to the construction of the logical system of related concepts,facilitate the maturity of the discipline of Inner Party Regulation,and accelerate the construction of multi-disciplinary dialogue field,and promote the construction of philosophy and social science discourse system with Chinese characteristics.
