摘　　要：依法打击黑社会性质组织犯罪,事关社会大局稳定和国家长治久安。为准确适用法律法规,避免在司法实践中“拔高”或“降格”认定,造成执法不平衡不统一,本文从该罪的立法来源、四个特征、司法认定等方面,系统梳理了司法实践中认定本罪的疑难问题和重点问题,以期为司法实践的运用提供有益借鉴。Crackdown on crimes of underworld gang organizations in accordance with the law helps maintain the overall social stability and long-term national security. In order to accurately apply the laws and regulations, and avoid the wrong judicial cognizance in practice----"elevating" or "downgrading", this article systematically reviews the difficult issues and key problems in the judicial cognizance of the organized crimes with gang nature from the legislative process, the four characteristics, and the judicial cognizance, with a view to providing useful reference for the application of judicial practice.
