军民融合背景下国防知识产权创新进路--以日本高校国防知识产权为借鉴

摘　　要：高校作为军民融合重要主体之一,科研创新资源及能力充沛。然而一直以来仅承担教育及普及知识作用的高校,开展国防知识产权创新仍面临如信息沟通不畅、高校评价机制不适应现今创新要求、相关知识产权制度落后于现实需要等障碍。在此方面,日本引入技术转让组织(Technology Licensing Organization, TLO)、创新知识产权制度、建立安全技术研究推广系统等举措引起关注。为进一步增强高校国防知识产权创新活力,中国可学习日本建构TLO解决信息障碍,创新国防知识产权制度改变以往的补偿费使用费过低的状况,提升高校及科研人员进行国防知识产权创新的积极性,对保密解密政策分类管理。由点到面突破障碍,最大程度发挥高校创新活力。As one of the important subjects of military civilian integration, colleges and universities have abundant scientific research and innovation resources and ability.However, colleges and universities that have only undertaken the role of education and popularization of knowledge still face obstacles in carrying out national defense intellectual property innovation, such as poor information communication, college evaluation mechanism does not meet the requirements of today’s innovation, and relevant intellectual property systems lag behind practical needs.In this regard, Japan has attracted attention by introducing technology licensing Organization(TLO),innovating intellectual property system and establishing security technology research and promotion system.In order to further enhance the innovation vitality of national defense intellectual property in Colleges and universities, China can learn from Japan’s construction of TLO to solve information barriers, innovate the national defense intellectual property system, change the previous situation of low compensation fees and royalties, improve the enthusiasm of colleges and universities and scientific researchers for national defense intellectual property innovation, and manage the confidentiality and decryption policies by categories.Break through obstacles from point to surface and give full play to the innovative vitality of colleges and universities.
