摘 要:现行法律、行政法规、公安部规章中明确指向公安机关及其内设机构适用训诫的规定共有9处。从制度变迁上看,其历经了申饬、训诫、申诫以及警告处罚。在当前公安行政执法中,训诫包含了作为警告执行方式、作为非法定罚处置方式、作为独立处置方式等多重维度。其中,前两类应定位为补充性行政事实行为,后一类应定位为建议性行政事实行为之下的规制性行政指导行为。有关部门应把握治安管理处罚法的修改契机,填补法律漏洞,及时上收公安行政法律文书式样制定权限,并在执法过程注重听取相对人的陈述和申辩,避免先入为主式判断,从而确保各项行政决定充分体现公平正义。In the current laws,administrative regulations and regulations of the Ministry of Public Security,there are 9 provisions that clearly point to the application of admonitions to public security organs and their internal institutions.From the perspective of institutional change,it has gone through admonishment,admonishment,admonishment and warning punishment.In the current public security administrative law enforcement,discipline includes multiple dimensions,such as warning execution,non-legal punishment and independent disposal.Among them,the first two types should be positioned as supplementary administrative factual acts,and the last type should be positioned as regulatory administrative guidance acts under the advisory administrative factual acts.The relevant departments should grasp the opportunity of the revision of the law on punishment for public security administration,fill in the legal loopholes,take over the authority of the formulation of public security administrative legal documents in time,and pay attention to listening to the statements and arguments of counterparts in the process of law enforcement,avoid preemptive judgment,so as to ensure that all administrative decisions fully reflect fairness and justice.
