摘 要:旨在探讨土地开发权的规划配置对集体产业用地转型的影响机制,助力规划实施;借鉴产权制度理论分析框架,揭示集体产业用地开发权重构的特征;通过数据分析剖析南海区集体产业用地的转型特征;以参与式观察和半结构性访谈开展典型案例研究对比,实证上述影响机制。研究发现:(1)规划管控加剧非均衡的开发权配置,将集体产业用地重构为开发权赋予、利益共识型,开发权削减、利益冲突型,和开发权取缔、利益矛盾型三类;(2)开发权赋予型用地容易改造。由于缺乏开发权益调节机制,开发权削减和取缔型用地转型困难。集体产业用地有序、合规的转型需配以公平的利益补偿机制,包括提高政府转移支付能力、强化市场在权益调节中的作用。This study aims to explore the impact of land development rights assignment under planning intervention on the transformation of collective industrial land, and further to promote planning implementation. Employing the property rights theory, this study reveals the characteristics of restructuring of development rights of collective industrial land;participatory observation and semi-structured interviews are used to investigate typical cases;through comparison among cases, the aforementioned influencing mechanism is revealed. The results show that:(1) Planning exacerbates imbalanced assignment of development rights, leading to three types of assignments of development rights to the collective industrial land: namely, rights entitled and interest in consensus, rights restricted and interest in conflict, and rights deprived and interest in contradiction.(2) It is easy to transform the first type of industrial land. However, due to lacking the system of balancing development rights and interests, it is difficult to transform the land of the second and third type. The sustainable transformation of collective industrial land depends on establishment of a balanced allocation system of development rights. It includes adding the government’s profit-sharing in land transformation of the first type, strengthening its capability of transfer payment, and enhancing the role of market in allocating rights and interests. The research provides a reference for balancing development and protection in China′s spatial restructuring oriented to high-quality development.
