摘 要:现行《食品安全法》本着社会共治和重典治乱原则,重建了食品损害民事责任体系,构筑了较为严厉的首负责任制、连带责任制和惩罚性赔偿制等制度,充分提升民事责任的惩罚、填补、激励和预防功能。《食品安全法》在制度构架和规范设计上也存在一些问题,一定程度上影响了法律规范的正确适用。《食品安全法》的修订应当参酌2021年1月1日起施行的《最高人民法院关于审理食品安全民事纠纷案件适用法律若干问题的解释(一)》,进一步优化食品损害民事责任体系,充分发挥民事责任制度的功能,积极鼓励消费者参与食品安全社会共治。The current Food Safety Law,based on the principles of social co-governance and severe punishment in chaos time,has rebuilt the civil liability system for food damage,constructed a more severe system of first responsibility,joint and several liability and punitive compensation,and fully improved the functions of civil liability such as punishment,filling,incentive and prevention.But there are still some problems in the institutional framework and standard design of the Food Safety Law,which affect the correct application of legal norms.The revision of the Food Safety Law should take into account the first interpretation of the Supreme People’s Court on Several Issues Concerning the Application of Law in the Trial of Civil Disputes over Food Safety,which come into force on January 1,2021,so as to further optimize the civil liability system for food damage,give full play to the function of the civil liability system,and actively encourage more consumers to participate in the social co-governance of food safety.
