摘 要:通过回顾图瓦卢籍散货船“安娜”轮触礁溢油事故致海洋渔业损害索赔案,引出我国海洋环境损害鉴定存在的官方鉴定机构偏少、鉴定人员素质有待提高、鉴定成本过大以及海洋环境容量鉴定意见不一等问题,并从引入市场机制、提高鉴定质量、降低鉴定成本等方面对完善我国海洋环境损害鉴定提出建议,以期在各方的共同努力以及相关标准的完善下,提高海洋环境容量损失、海洋渔业资源损失等鉴定的科学性,进一步保障油污受害人及各方的利益。The paper proceeds from the damage compensation case of the fishing industry resulted from the oil spill of"ANA",a Tuvalu bulk carrier,following a stranding accident.Then it probes into the problems of marine environmental damage assessment in China,including the small number of official institutions,inadquate personnel qualification,high costs,and inconsistent conclusions in the assessment of marine environmental capacity.It further puts forward suggestions for improving the assessment,including the introduction of market mechanism,improving the quality of assessment,reducing costs,etc.,aiming at ensuring scientific assessment of marine environment capacity loss and fishing resource loss under the joint efforts of parties concerned and improvement of relevant standard in order to protect the rights of the victims of oil pollution damage and other related parties.
