窃电刑事责任追究中的主要争点及应对

摘　　要：刑事责任是最严重的法律责任,本应对遏制窃电案件的发生发挥顶梁柱的作用,但实践中针对窃电案提起公诉追究窃电人刑事责任的案件并不多。就是已经提起公诉的窃电案,也因为刑事诉讼过程中的各种法律原因让有些窃电人脱罪或者只能从轻处罚。如果还存在人为失误,后果就更为不理想。唯有通过梳理窃电案审理过程中的主要争点,发现存在的问题,找到解决办法,降低人为失误,方能为以后的反窃电行动提供指南,最大限度遏制实践中屡禁不止的窃电行为。Criminal responsibility is the most serious legal responsibility,it should play an important role in curbing the occurrence of electricity-stealing cases,but in practice,the prosecution of electricity-stealing cases to investigate the criminal responsibility of such cases are not many.Even after the case of electricity theft has been prosecuted,because of various legal reasons in the course of criminal proceedings,some electricity thieves have been acquitted or punished minorly.If there are still human errors,the consequences are even less ideal.Only by combing the main points in the process of electricity-stealing trial,finding out the existing problems,solutions and reducing human errors,can we provide a guide for the future anti-electricity theft action and minimize the repeated prohibition of electricity-stealing in practice.
