党政联合发文的“党内规范”属性及其效力

摘　　要：党政联合发文是国家常用的一种制定、颁发制度性和政策性文件的形式,其已发展为一种治国理政的常态化工具。通过对《中国共产党党内法规制定条例》第13条第2款的规范解释,“党政机关联合”能够成为“党内规范”的制定主体。在此基础上,党政联合发文具有“党内规范”属性,可以区分为“党内法规”和“党内规范性文件”两种类型。“党内规范性文件”类党政联合发文可进一步区分为“政策指导型”和“政策实施型”。党政联合发文除具有适用于党政机关的内部效力以外,“党内法规”类党政联合发文具有适用于党政机关以外的组织和个人的直接外部效力;“党内规范性文件”类党政联合发文具有适用于党政机关以外的组织和个人的间接外部效力。Jointly issuing documents by the party and government is a form of formulation and issuance of institutional and policy documents commonly used by the country,and it has developed into a normalized tool for state governance.Through the normative interpretation of Article 13 paragraph 2 of the“Regulations on the Formulation of Inner-Party Regulations of the Communist Party of China”,the“joint of party and government agencies”can become the main body of the formulation of“inner-party norms”.On this basis,the party-government joint document has the attribute of“inner party norms”and can be divided into two types:“inner party regulations”and“inner party normative documents.”The“internal party normative documents”issued by the party and government can be further divided into“policy guidance type”and“policy implementation type.”In addition to the internal effects applicable to party and government agencies,joint party and government documents issued by the Party and government have direct external effects applicable to organizations and individuals other than party and government agencies;“internal party regulatory documents”category jointly issued documents by the party and government have indirect external effects applicable to organizations and individuals other than party and government agencies.
