摘　　要：目的:了解我国卫生行政执法现状,为卫生行政部门依法全面履行管理职责、提高行政诉讼应诉能力提供参考。方法:在“中国裁判文书网”上选取全国2015-2019年卫生行政部门行政诉讼二审败诉案件197件,对案件信息进行统计分析。结果:目前我国卫生行政执法败诉案件类型广泛,败诉案件数量与占比总体呈上升趋势,败诉率与地域经济发展水平有关联;司法机关对卫生行政部门行政行为的审查趋于严格,但行政复议程序在解决卫生行政争议中作用发挥不理想;医学专业领域法律法规的适用错误情形较为常见,卫生行政部门法律素养有待加强。结论:我国卫生行政执法面临的社会和司法监督压力有增无减,应加强对医患双方的法治宣传,完善行政复议制度,增强卫生行政履职意识,提高证据收集与固定能力,规范执法程序。Objective:To understand the status quo of health administration law enforcement in China so as to provide suggestions for the health administrative department to fulfill their management responsibilities according to law and improve their ability to respond to administrative litigation.Methods:197 losing cases(second instance)of health administrative department in administrative litigation in China were selected through the“China judgments online”ranging from 2015 to 2019,and statistical analysis were conducted based on the cases.Results:In recent years,health administrative law enforcement in China has a wide range of losing cases,and the number and proportion of losing cases have generally been on the rise.The failure rate is related to the level of regional economic development.Judicial organs tend to be stricter on the administrative actions of health administrative departments,but administrative reconsideration procedures do not play an ideal role in resolving health administrative disputes,the application of laws and regulations in the medical professional field is more common,and the legal literacy of the health administrative department needs to be strengthened.Conclusion:The pressure of social and judicial supervision on health administration law enforcement in China is increasing,so we should strengthen the publicity of the rule of law to both doctors and patients,and improve the administrative review system.Meanwhile,we should enhance the duty consciousness of Health Authorities,enhance their ability of evidence collection and fixation,and standardize the law enforcement procedures.
