复制权与信息网络传播权的关系

摘　　要：多数信息网络传播权规制的交互式网络传播行为都涉及复制,即将作品上传至网络服务器。但仍有部分交互式网络传播行为无须传播者首先复制作品,因此交互式网络传播行为与复制行为并不重合。作品一经上传,复制行为即告结束,无所谓停止侵权。通过上传侵害复制权造成的损失仅为制作一份复制件应支付的许可费,与网络传播的范围与时间无关,因此仅凭借复制权不足以在网络环境中保护权利人的利益。版式设计权仅包含复制权,不包含信息网络传播权,法院不应对未经许可扫描并上传图书、期刊的行为适用版式设计权。信息网络传播权的许可合同即使不包含对复制权的许可,也应根据合同的目的进行合理解释。Most interactive network communication behaviors regulated by the right of information network communication involve copying,that is,uploading works to a network server.However,there are still some interactive network communication behaviors that do not require the communicator to copy the work first,so interactive network communication behaviors and copying behaviors do not overlap.Once the work is uploaded,the copying will end,and there is no need to stop the infringement.The loss caused by the infringement of the copy right through uploading is only the license fee payable for making a copy,and has nothing to do with the scope and time of network transmission.Therefore,the copy right alone is not enough to protect the rights of the right holder in the network environment.The right of layout design only includes the right of reproduction and does not include the right of information network dissemination.The court shall not apply the right of layout design to the act of scanning and uploading books and periodicals without permission.Even if the licensing contract for the right of information network dissemination does not include the licensing of the right of reproduction,a reasonable explanation should be made based on the purpose of the contract.
