论党内法规的法典化

摘　　要：党内法规的发展采纳了法典的技术方法,建立了概念体系,规范了语言表述,形成了“总则—分则—罚则—附则”的体例结构,采纳了“原则—规则”的规范构造和“假定条件—行为模式—法律后果”的规则形式,逐渐脱离党的文件系统,成为相对独立的一类规范。法典化可以消除党内法规体系内在的矛盾,增强党规之间的融贯性,提升党内法规的公开力度。党内法规的法典化具备现实可行性,四大部门的划分为法典化奠定了基础。法典性质的党内法规可以采取“条例”的名称。党的组织法规和监督法规适合开展实质性法典编纂,党的领导法规和自身建设法规适合开展形式性法典编纂,党的保障法规需要区别对待。The development of the CPC internal codes and regulations adopted the technical methods of codification by establishing the conceptual system,standardizing language expression,forming a structure of“general rules,specific provisions,punitive provisions,and supplementary provisions”,and adopting the“principles-rules”normative structure and the normative forms of“assuming conditions-behavior patterns-legal consequences”.It has gradually deviated from the Party’s document system and become a relatively independent category of norms.Codification can help eliminate the contradictions inherent in the Party’s internal code and regulations system,enhance the coherence between Party regulations,and enhance the disclosure intensity of Party regulations.The codification of the Party’s internal codes and regulations is practical and feasible.The responsibility division of the four major departments has laid the foundation for the codification.Party regulations with codification attributes can take the name of“regulations”.The Party’s organizational regulations and supervision regulations are suitable for substantive codification,while the Party’s leadership regulations and self-construction regulations are suitable for formal codification;the Party’s supporting regulations should be treated differently.
