摘 要:南海资源丰富,具有重要的战略价值和国际影响力。中国早在20世纪70年代就积极推动争议海域共同开发,但是至今未有成功的案例。未来南海共同开发需要解决以下基本法律问题:明确共同开发的主体、界定共同开发区块、就利益分配达成共识、确定共同开发管理机制、选择共同开发区适用的法律、解决“先存权”问题和妥善协调第三方权利、达成具有法律约束力的共同开发协议。南海共同开发既要保持公平性,也应体现适度的灵活性以实现区域内外国家的共赢,使南海真正成为“和平之海”“和谐之海”“友谊之海”。The South China Sea is rich in resources and has important strategic value and international influence.China has been actively promoting joint development in the disputed waters since the 1970s,but there have been no successful cases so far.The following basic legal issues need to be resolved for future joint development in the South China Sea,namely,clarifying the subjects of joint development,defining the joint development areas,reaching a consensus on the distribution of benefits,determining the management mechanism of joint development,selecting the applicable law for joint development,resolving the issue of“pre-existing rights”for proper coordination of the rights of the third parties,and reaching a legally binding agreement of joint development.The joint development of the South China Sea should not only maintain fairness but also reflect moderate flexibility to achieve a win-win situation for the countries inside and outside the region.In this way,the South China Sea can truly become a“sea of peace”,“sea of harmony”and“sea of friendship”.
