论马克思主义“法律的阶级分析法”的当代适用

摘　　要：完全否定法律的阶级分析法、法律的阶级维度,与过度强调法律的阶级统治论、阶级斗争工具论一样,都不是看待法律现象的正确态度,也不可能形成指导法治国家建设的科学理论。问题在于如何提炼这个时代所需要的法律的阶级分析法,一种不同于“阶级斗争法学”或“法学的阶级斗争范式”的分析法律现象的科学方法论。法治国家建设不能忽略阶级问题,应该把厘清生产关系、解决阶级问题作为一项任务,防止可能的阶级固化和阶级冲突加剧,防止本来应该是体现人民意志的法律只是表面上、形式上的,实际上还是代表少数人的意志。只有等到法律体现大多数人的、全社会的意志的时候,才可以说实现了马克思主义意义上的真正的法治社会。法律越来越不是少数人意志的体现,阶级之间对立性不断削弱、统一性不断增强,可以说正是通往真正意义上的法治国家的过程。A denial of class analysis and class dimension,of law,the same as a practice that overemphasizes the class rule theory and the tool theory on class struggle is not the proper attitude to treat the legal phenomenon,and it is impossible to form a scientific theory to guide the construction of a country ruled by law.The problem lies in how to refine the class analysis of law needed in this era,a scientific methodology for analyzing legal phenomena,different from“class struggle law”or“class struggle paradigm of law”.To build a law-based country,we cannot ignore class problems.That is to say,we should take clarifying production relations and solving class problems as a task to prevent possible class solidification and intensification of class conflicts,and prevent laws that should reflect the will of the majority from running superficially and in paper and representing the will of the minority.Only when the law reflects the will of the majority and the whole society can it be said that a real law-based society in the sense of Marxism has been built.A law-based country will be ushered in when law is increasingly not the embodiment of the will of the minority,and the opposition between classes is in decline and the unity is gaining weights.
