服务贸易开放“承诺方式由正转负”压力下海南自贸港制度创新研究

摘　　要：在RCEP与CPTPP框架下我国均面临着要基于负面清单同时对“外资准入”和“跨境服贸”做出开放承诺的现实压力。作为国内唯一已实现用两份负面清单来分别管理“外资准入”和“跨境服贸”对外开放的自贸区(港),海南在负面清单相关的制度创新方面更具基础和优势。海南可以率先依据国际惯例与规则对现存两份负面清单从格式架构和内容要件上进行调整完善并尝试将两单合一,并在此基础上补充水平适用的不符措施和根据海南实践进行调整修订,最终实现以符合国际惯例的整合版负面清单做出相关的对外开放承诺。Under the framework of RCEP and CPTPP,China is facing realistic pressure to make open commitments to“foreign investment access”and“cross-border service trade”based on the negative list.As the only free trade zone(port)in China that has implemented the use of two negative lists to manage“foreign investment access”and“cross border service trade”respectively,Hainan has more foundation and advantages in institutional innovation related to the“negative list”.Hainan can take the lead in adjusting and improving the two existing negative lists in terms of format structure and content elements in accordance with international practices and rules,and try to combine the two lists,and finally realize the relevant opening-up commitments with an integrated version of the negative list that conforms to international practice.
