摘 要:《民法典》绿色条款的具体适用和环境法典编纂都对类型化提出了迫切需求。民法典绿色条款可分为融合性条款、限制性条款、激励性条款、救济性条款、扩展性条款。融合性条款建立环境与发展双赢机制,限制性条款彰显中华传统生态智慧,激励性条款连接新型环境民事权利,救济性条款打通“双向转介”管道,扩展性条款预留生态环境公益保护空间。环境法典编纂应与《民法典》绿色条款相衔接,实现环境法典框架结构与绿色条款的有效沟通。编纂环境法典时可借鉴《民法典》绿色条款类型化的经验,使环境管理规范为限制性条款提供更清晰的“准据”,通过特别民事规范实现激励性条款的细化,完善专门环境责任机制为救济性条款与扩展性条款的适用创造条件。The specific application of the green clauses in the Civil Code and the compilation of the Environmental Code all put forward an urgent need for typification.The green clauses of the Civil Code can be divided into integration clauses, restrictive clauses, incentive clauses, relief clauses, and extension clauses.Integration clauses establish a win-win mechanism for environment and development;restrictive clauses demonstrate traditional Chinese ecological wisdom;incentive clauses link new environmental civil rights;relief clauses open up a “two-way referral”channel, and extension clauses reserve space for ecological environment public interest protection.The codification of the Environmental Code should be linked with the green clauses in the Civil Code to achieve effective communication between the framework of the Environmental Code and the green clauses.When compiling the Environmental Code, we can learn from the experience of typification of the green clauses in the Civil Code, so that the environmental management regulations provide clearer guidance for restrictive clauses, realize the refinement of incentive clauses through special civil regulations, and improve the special environmental liability mechanism to create conditions for the application of relief clauses and extension clauses.
