论行政复议管辖集中后的部门专业性保障

摘　　要：行政复议相对于行政诉讼在行政行为合理性审查方面的专业优势是其制度优势的根本所在。行政行为合理性审查对行政管理专业知识和业务经验的要求存在部门性差异,由此产生了行政复议案件审理的部门专业性。地方行政复议案件改由政府集中管辖和审理后,主管部门审理本领域行政复议案件所具有的部门专业性优势将难以为继,现有与行政复议专业性建设相关的几项措施也无法排解行政复议案件审理的部门专业性隐忧。借鉴部分国家和地区的经验,结合我国行政复议体制改革走向和国家公务员管理的制度实践,我国行政复议案件审理的部门专业性保障需要在行政复议机构内部实行专业化分组,强化行政复议人员的部门专业素质保障,并对行政复议人员实行分类培训。Compared with administrative litigation system,administrative review system has a professional advantage in reviewing the rationality of administrative actions,which is the foundation of its institutional advantages.There are departmental differences in the requirements for administrative professional knowledge and professional experience in reviewing the rationality of administrative actions,which results in departmental professionality in the hearing of administrative review cases.Under the background of Centralized Jurisdiction and trial of the local administrative review cases,the professional advantage of the competent department in hearing administrative review cases in this field will be difficult to continue,and the existing measures related to the professional construction of administrative review cannot eliminate the concerns of the departmental professionality in hearing administrative review cases.Based on the experience of some countries and regions,and combined with the reform trend of China’s administrative review system and administrative civil servant management system practice,in order to ensure the departmental professionality of administrative review cases in China,it is necessary to implement specialized groups in administrative review institutions,appoint non-leading senior administrative civil servants as permanent members of administrative review and carry out classified training for administrative review personnel.
