摘　　要：我国尚存在的流域补偿正当性标准之争,影响了该制度存在的合法性根基和生态保护补偿专门立法的制度构建。将“高于强制性水质要求的环境质量提升标准”作为流域补偿的正当依据,曲解了这一制度的应然价值及合理逻辑。以“纯粹的水环境质量提升标准”作为理论基础,本质上具备科学性,但尚需正视该标准持有的学说论证困境。从政府的环境治理职责和纯粹的水环境质量提升型流域补偿应协同并存,纯粹的水环境质量提升型补偿具备法律依据且可以破解区域协调发展的关键难题三方面着手,可以深入阐明流域补偿制度的正当性依据。流域补偿制度的立法解释,应契合“纯粹的水环境质量提升标准”之价值目标,并立足于应然定位,进行类型化的规则考察。There are still disputes over the legitimacy standards of river basin compensation system in China,which affects the legal foundation of the system and system construction of eco-protection compensation legislation.Taking“environmental quality improvement standards higher than the mandatory water quality requirements”as the legitimate basis for river basin compensation system is a misunderstanding of its due value and reasonable logic,while it is substantially scientific to take“pure water environmental quality improvement standards”as a theoretical basis.However,the difficulty of demonstrating the theory needs to be noted as well.Evidence of the legitimacy of river basin compensation system can be deeply clarified from three aspects:coexistence of government’s responsibility of environmental governance and river basin compensation of pure water environmental quality improvement,legal basis of river basin compensation of pure water environmental quality improvement and facing key problems of regional harmonious development.Legislation of river basin compensation system should be in accordance with the core value of“pure water environmental quality improvement standards”and be established in its due position while conducting categorized rule inspections.
