论中国投资争端预防机制之优化路径

摘　　要：数量庞大的双边投资条约、长期处于高位的外国直接投资流量、不完备的外国投资保护机制等众多因素的叠加,加剧了中国政府被外国投资者诉诸投资仲裁庭的风险,势必对中国政府的规制权与外国投资者的利益产生消极影响。从根本上说,中国政府应对上述风险的最佳方式是进一步优化本国的投资争端预防机制。通过有选择地借鉴域外投资争端预防机制的有益经验,中国应设立协调与解决外国投资者诉求的专门委员会、增进地方政府对投资条约义务的认知度、提高国内投资政策与法律的透明度、确定并监控敏感或重大的外国投资领域,以及积极使用行政复议与外资企业投诉机制。这不仅有助于外国投资者与中国政府形成长期互惠与合作关系,还能最大限度地降低投资争端解决成本以及优化本国的营商环境。The huge number of bilateral investment treaties, long-term high foreign direct investment flow and incompleteness of the protection system for foreign investment and many factors combined, which aggravate the risks of Chinese government being brought to the investment tribunal by foreign investors, and negatively impact the right of regulation of Chinese government and the interest of foreign investor. Basically speaking, to further optimize domestic investment dispute prevention mechanism is the best approach for Chinese government to eliminate above risks.Through selectively making reference to the good experience of foreign investment dispute prevention mechanism, China shall establish specialized committee of coordination and resolution for foreign investor claims, increase local governments’ awareness of investment treaty obligations, improve the transparency of domestic investment policies and laws, identify and monitor sensitive or significant investment sectors as well as actively utilize administrative reconsideration and the complaint mechanism for foreign investment enterprise. This will not only contribute to the long-term reciprocal and cooperative relation between foreign investors and Chinese government, but also can reduce the cost of investment dispute settlement to the maximum extent and refine domestic business environments.
