摘　　要：协议购买方式在我国土地征收实践中被广泛适用,但现行法律尚未对其效力进行确认,由此引发了大量的纠纷乃至诉讼。相较于传统的征收方式,协议购买以市场化的方式取得公益用地,不仅能够以平等协商的方式实现交易,还能降低融资成本、提高征收效率,是破解征收难题的有益探索。将协议购买制度引入土地征收程序,要考虑其与现行征收制度的衔接,应将其作为征收的前置程序。协议购买的条件可以参照集体经营性建设用地入市的条件,购买协议的性质为行政协议,发生集体所有土地转化为国有土地的法律效果。通过协议购买程序取得的公益用地,在符合土地规划的前提下,由市县人民政府批准后直接办理登记手续。The agreement purchase method is widely used in the practice of land expropriation in China, but its effectiveness has not been confirmed by the current law, which has caused a large number of disputes and even litigation. Compared with traditional way of expropriation, the acquisition of public land by agreement in a market-oriented way can not only realize the transaction through equal negotiation, but also reduce the financing cost and improve the efficiency of expropriation, which is a useful exploration to solve the problem of expropriation. The introduction of the agreement purchase system into the land expropriation procedure should consider its connection with the current expropriation system, and it should be used as a pre-expropriation procedure. The conditions of contracted purchase can refer to the conditions of entering the market for collectively-run construction land. The nature of the purchase agreement is an administrative agreement, which has the legal effect of transforming collectively owned land into state-owned land. The public welfare land acquired through the agreement purchase procedure shall be directly registered after the approval of the municipal and county people’s government on the premise that it conforms to the land planning.
