个案对法制进程的影响——以江阴市危险驾驶定性为紧急避险案为例

摘　　要：个案在推进法制进程的过程中发挥着举足轻重的作用。典型个案的判决结果甚至可以促成一部新法的出台或者旧法的修改,亦或者是对某个法律条文的适用产生影响。江阴市危险驾驶的性质被定性为紧急避险案必定会引发争议,对于法制进程的推进起到的影响是很大的。江阴市危险驾驶定性为紧急避险案,判决缺乏有力的裁判说明,不能解决醉驾适用紧急避险在学界和实务界所产生的问题,应当对案件重新梳理并探究如何让个案更有利于推进法制进程。Individual cases play an important role in promoting the process of legal system. The conclusion of a typical case can even lead to the introduction of a new law or the amendment of the old law, or affect the application of a certain legal provision. The nature of dangerous driving in Jiangyin City is defined as an emergency risk avoidance case, which will inevitably lead to controversy and play an indispensable role in promoting the legal process. Jiangyin dangerous driving is defined as the case of emergency avoidance. The judgment lacks favorable judgment explanation, which can not solve the problems caused by the application of drunk driving in the academic and practical circles. We should re sort out the case and explore how to make the case more conducive to promoting the legal process.
