摘　　要：老年心智障碍者家庭面临养老和助残双重压力,其核心是如何有效管理财产并将其专用于心智障碍者权益保障之中。信托制度所具有的财产管理专业性、委托人意思冻结功能、信托财产独立性等特性,适于化解此类家庭的担忧,确保受益人的合法权益。老年心智障碍者保障信托包括私益信托和公益信托两种模式。老年心智障碍保障信托的设立、信托财产、信托当事人也应根据信托模式相应设计,以满足心智障碍者家庭的实际需要。Families of the elderly with mental handicapped face the dual pressures of supporting the elderly and assisting the disabled.The core is how to effectively manage property and use it exclusively for the protection of the rights and interests of the mentally handicapped.The trust system has the characteristics of professional property management,the function of freezing the trustee s wills,and the independence of the trust property,which are suitable for resolving the concerns of such families and ensuring the legitimate rights and interests of the beneficiaries.The protective trust for the elderly with mentally handicapped includes two models:private trust and public trust.The establishment,trust property,and trust parties of a mentally handicapped protective trust for the elderly should also be designed according to the trust model to meet the actual needs of the mentally handicapped family.
