乡村振兴背景下农村闲置宅基地和闲置住宅盘活利用的实践考察及立法回应

摘　　要：2018年中央一号文件首次提出的宅基地“三权分置”是实施乡村振兴战略的具体安排之一。将宅基地“三权分置”表达为“宅基地所有权、宅基地使用权、宅基地租赁权或经营权等”是农村闲置宅基地和闲置住宅盘活利用的必要理论支撑。社会实证调研结果显示,乡村振兴背景下农村闲置宅基地和闲置住宅盘活利用实践探索面临农村“房地一体”的确权登记发证尚未完成,试点地方规定形式多、内容不明确,盘活利用方式单一,盘活利用管理主体职责不清等诸多现实障碍。农村闲置宅基地和闲置住宅盘活利用需要立法回应。建议加强农村“房地一体”的确权登记制度;制定“农村闲置宅基地和闲置住宅盘活利用办法”;对闲置宅基地和闲置住宅盘活利用多种方式进行规范;明确农村集体经济组织的管理主体职责。在厘清农村宅基地“三权分置”权利体系表达的基础上,构建可适用于全国领域的农村闲置宅基地和闲置住宅盘活利用法律规则体系。In 2018,the policy of“three rights separation”in the residential land was proposed in the Central Document No.1,which provides national policy support and theoretical basis for the revitalization and utilization of idle homestead and idle housing.The results of social empirical research show that the practical exploration of revitalizing the utilization of local idle homestead and idle housing faces many practical obstacles:the confirmation,registration and certification of rural“real estate integration”has not been completed,the pilot local regulations are quite different,the revitalizing method is single,and the responsibilities of revitalizing and utilization management subjects are unclear.It is suggested to improve the right confirmation and registration system of rural real estate integration,to formulate special measures for the revitalization and utilization of rural idle homestead and idle housing,to make specific provisions on various ways of revitalizing and utilizing idle homestead and idle housing and to specify the powers and responsibilities of various management subjects of homestead in order to benefit the theory and practice.
