摘　　要：裁判文书的对话性,是说裁判文书是一种对话,裁判文书具有对话的性质。裁判文书的对话性,旨在从对话的角度看待裁判文书。对话是一种更重视裁判文书受众的说理。裁判文书对话性包含三个维度:对话的对象,对话的方式,对话的内容。加强裁判文书的对话性,是进一步加强裁判文书说理性、提高裁判文书质量,充分发挥其应有作用的一个重要抓手;加强裁判文书的对话性,对于更好发挥裁判文书的三种功能、实现社会主义核心价值观的要求以及人民法院有效回应社会情势,具有重要作用。实现裁判文书的对话性要求:一方面,裁判文书应当清晰、一致、有根据、有针对性;另一方面,法官要有同理心、对话应符合常理常情。实现裁判文书对话性需要四个制度条件,并需要法官具有人文关怀立场。The dialogical nature of the judgement documents means that the judgement process is like a dialogue and has a dialogical nature. The dialogical nature of the judgement aims to view the judgement from a dialogical perspective. Dialogue is a kind of reasoning that attaches more importance to the audience of the judgement. The dialogical nature of the judgement encompasses three dimensions: the object of dialogue, the way of dialogue, and the content of dialogue. To strengthen the dialogical nature of judgement documents is an important tool to further strengthen the reasoning of judgement, improve the quality of judgement, and give full play to their proper role. Strengthening the dialogical nature of judgement plays an important role in better playing the three functions of judgement, realizing the requirements of core socialist values and the People’s Courts’ effective response to social situations. The dialogue of judgement documents requires that, on the one hand, judgement should be clear, consistent, wellfounded and relevant;on the other hand, judges should be empathetic, and dialogue should be in line with common sense. Four institutional conditions are needed to achieve the dialogical nature of judgement, and judges need to have a humanistic stance.
