摘 要:民国时期,不动产登记制度作为确定与保障私有产权的重要法律制度,改变了中国传统社会“契据为凭”的“管业”模式,开启了产权近代化的发展道路。不动产登记制度的出现,打破了传统社会产权保障机制的“双轨制”结构,并走向“由政入法”的阶段。在不动产登记制度发展过程中,因司法登记确权与行政赋税征收引发利益冲突与矛盾。期间土地登记与不动产登记的此兴彼衰体现出“政大于法”的演变趋势,最终土地登记全面取代不动产登记。民国时期不动产登记制度的兴衰过程展现了“法政纠结”的复杂面相,蕴含着近代中国法律制度、机构设置以及产权观念的深刻变化。During the period of the Republic of China,the real estate registration system,as an important legal system to determine and protect private property rights,changed the “management” mode of “contracts based” in Chinese traditional society,and opened the development path of property rights modernization.The emergence of the real estate registration system has broken the “double track system” structure of the traditional social property right security mechanism and moved towards the stage of “entering law from politics”.In the process of the development of real estate registration system,the interest conflicts and contradictions caused by the confirmation of power in judicial registration and the collection of administrative taxes reflect the difficult choice of “politics or law”.During this period,the rise and fall of land registration and real estate registration reflected the evolution trend of “politics is greater than law”,and finally land registration completely replaced real estate registration.The rise and fall of the real estate registration system in the period of the Republic of China shows the complex face of “legal and political entanglement”,which contains the profound changes in the legal system,institutional setting and the concept of property rights in modern China.
