摘　　要：公共体育服务合同外包是扩大公共体育服务供给、深化体育事业改革、转变政府职能的创新性选择。系统把握我国公共体育服务合同外包运作的规律,运用文献资料法、案例分析等方法,分析竞争模式、谈判模式、体制内外包模式等合同外包模式的特征、适用情形、成效与缺点。研究结果表明,我国公共体育服务合同外包实践中存在的现实问题,是竞争模式难以普及、谈判模式和体制内外包模式运作受限的主要原因。因此,需要尽快出台公共体育服务合同外包相关法律与政策、完善相关政策法规体系建设,重视培育公共体育服务供方市场,建立公平合理的招投标机制,完善公共体育服务合同外包监管机制,加强公共体育服务合同外包绩效评价体系建设,以进一步优化公共体育服务合同外包行为。Outsourcing of public sport service contracts is an innovative choice to expand the supply of public sport service,deepen the reform of sport undertakings and change the government functions.Based on systematically grasping the law of outsourcing operation of public sports service contracts in China,this paper analyzes the characteristics,applicable conditions,effects and shortcomings of contract outsourcing modes,such as competition mode,negotiation mode and outsourcing mode within the system,by using the methods of literature and case analysis.The results show that the practical problems existing in the practice of public sports service contract outsourcing in China are the main reasons why the competition mode is difficult to popularize and the operation of negotiation mode and outsourcing mode within the system is limited.Therefore,it is necessary to promulgate laws and policies related to public sports service contract outsourcing as soon as possible,improve the construction of relevant policies and regulations system,attach importance to cultivating the public sports service supplier market,establish a fair and reasonable bidding mechanism,improve the supervision mechanism of public sports service contract outsourcing,and strengthen the construction of performance evaluation system of public sports service contract outsourcing,in order to further optimize the public sports service contract outsourcing behavior.
