论低碳革命与能源革命的法律实现

摘　　要：能源革命不是低碳革命的全部,却是低碳革命的主角;制度创新不是破坏性创新的全部,却是低碳革命创新的主体;市场制度不是制度创新全部路径,却是低碳革命的必由之路;能源法律革命不是低碳革命制度创新的全部,却是其赖以实现的制度革命。中国能源法要以推动能源革命来进一步追逐低碳革命,就必须从适应碳达峰到适应碳中和,不断通过制度演化与制度创新,进而推动技术破坏性创新。必须承认,市场经济体制的建立与政党政治的转型是能源法制度功能发挥的前提。While the energy revolution does not constitute the entirety of the low carbon revolution,it is an important part of it.Although institutional innovation does not constitute the entirety of disruptive innovation,it is the mainstay of low-carbon revolutionary innovation.Market systems are not the entire path to institutional innovation,but they constitute a necessary path to a low-carbon revolution.The energy law revolution is not the entirety of the institutional innovation of low-carbon revolution,but it is the fundamental system upon which it is based.China′s energy law should promote energy revolution to achieve a low-carbon revolution.The legal system should transform to adapt to carbon neutrality instead of carbon peaking,continuously through institutional evolution and innovation,and then to promote technological disruptive innovation.The establishment of the market economy system and the transformation of party politics are the prerequisites for the function of the energy law system.
