摘　　要：月球自然资源开发趋势明显,确定月球自然资源的法律属性能够满足理论和实践层面的双重需求。分阶段地厘清月球自然资源法律属性有助于填补法律属性阶段式转换的理论鸿沟和实现《外空条约》与《月球协定》之间的有效衔接。未开发阶段,月球自然资源基于纯粹的自然性禀赋而属于“无主物”。开发阶段,“人类共同体”依据先占原则对月球自然资源实施占有从而使得其具有“人类共同财产”的法律属性。The trend of developing lunar natural resources is obvious.Determining the legal attributes of lunar natural resources can meet the dual needs of theory and practice.To clarify the legal attributes of the lunar natu⁃ral resources by stages will help fill the theoretical gap in the staged transformation of legal attributes and achieve an effective connection between the Outer Space Treaty and the Lunar Agreement.In the undeveloped stage,the natural resources of the moon belong to no owner based on pure natural endowment.In the development stage,the human community takes possession of the natural resources of the moon based on the principle of pre⁃emption so that it has the legal attributes of human common property.
