摘　　要：元宇宙是以数据和算力为依托,融合显示技术、区块链技术和人工智能技术于一体的,拥有独立社交环境、全真体感和独立经济体系的相对独立于现实世界的虚拟世界。元宇宙中部分虚拟财产具备客观价值性和流通性,非法获取元宇宙中虚拟财产的行为可能构成刑法中的相关财产犯罪。元宇宙中严重侵犯虚拟名誉权的行为可能构成侮辱罪、诽谤罪。刑法应将元宇宙中单独对精神权益进行严重损害的行为规定为犯罪,并设立侵犯精神健康罪等相关罪名。刑法应将元宇宙中妨害虚拟社会管理秩序行为规定为犯罪,并设立妨害信息网络管理秩序罪。Metaverse is based on data and computing power,integrates display technology,blockchain technology and artificial intelligence technology.It has an independent social environment,a real sense of body and an independent economic system.It is relatively independent of the real world.Part of the virtual property in Metaverse has objective value and liquidity.The illegal acquisition of virtual property in Metaverse may constitute a related property crime in the criminal law.The serious violation of the virtual reputation right in Metaverse may constitute the crime of insult and slander.The criminal law should stipulate the act of serious damage to spiritual rights and interests in Metaverse as a crime,and establish related crimes such as the crime of infringement of mental health.The criminal law should stipulate the violation of the management order of the virtual society in Metaverse as a crime,and establish the crime of disrupting the management order of the information network.
