破产财产网络拍卖的深度透析

摘　　要：“破产财产”仅指进入破产清算程序的“债务人财产”,发生在债务人被宣告破产之前的“债务人财产”网络拍卖不属于“破产财产网络拍卖”的范畴。债务人被宣告破产后,管理人依法继续履行合同而处分“破产财产”的行为,虽应受到债权人委员会和破产法院的监督,但不构成“变价出售破产财产”。在网络司法拍卖平台上变价出售破产财产行为的法律性质是公法拍卖,参照适用网络司法拍卖规则。但是,鉴于破产清算的特殊性,破产财产网络拍卖应当确立若干有别于网络司法拍卖规则的特殊规则。"Bankruptcy property"only refers to the"debtor's property"disposed in bankruptcy liquidation proceedings.The online auction of"debtor's property"occurring before the debtor is declared bankrupt does not belong to"online auction of bankruptcy property".After the debtor is declared bankrupt,the administrator may continue to dispose"bankruptcy property"in order to perform the contract.The administrator should accept the supervision of creditors'committee and bankruptcy court,but such disposition of bankruptcy property does not fall within the category of"selling bankrupt property".Auction of bankrupt property on online judicial auction platform should be defined as public law auctions and reference to the application of network judicial auction rules.However,in view of the particularity of bankruptcy liquidation,online auction of bankruptcy property should establish some special rules which are different from the rules of ordinary online judicial auction.
