摘　　要：在重大疫情期间,编造、故意传播有关疫情的虚假信息,不仅会阻碍疫情防控,还会加剧民众内心的恐慌,极易引发社会混乱。司法机关对该行为予以惩治时出现了编造、故意传播虚假恐怖信息罪和编造、故意传播虚假信息罪的适用争议。对比两种入罪路径,二者设立的背景不同,犯罪对象的关系特殊,实行行为的单复组合不一,信息传播方式有别,适用效果差别较大。对于虚假疫情信息的认定应把握恐怖信息的恐怖性特征,全面理解相关司法解释意旨,严格坚守罪刑法定原则,从而对编造传播虚假疫情信息行为以编造、故意传播虚假信息罪规制。During a major epidemic, fabricating and deliberately disseminating false information about the epidemic will not only hinder the prevention and control of the epidemic, but also aggravate the panic in the hearts of the people and cause social chaos easily. When the judicial organ punishes the behavior, there are disputes about the application of the crime of fabricating and deliberately disseminating false terrorist information and the crime of fabricating and deliberately disseminating false information. Comparing the two ways of conviction, it is found that the backgrounds of the establishment of the two are different, the relationship between the criminal objects is special, the combination of single and complex acts of execution are different, the methods of information dissemination are different, and the application effects are quite different. For the identification of false epidemic information, attention should be paid to the terrorist characteristics of terrorist information, a comprehensive understanding of the intent of relevant judicial interpretations, and strict adherence to the principle of statutory crimes and punishments, so as to regulate the crime of fabricating and deliberately disseminating false information by fabricating and disseminating false information.
