摘　　要：阻断法自产生至今经历过四次立法浪潮,并围绕证据开示、外国措施、外国法院判决以及追偿救济形成四项核心阻断条款。域外实践表明,阻断条款的实施,将涉及“立法国—被阻断国”“立法国—立法国国民”以及“立法国—被阻断国国民”三对主体,需要平衡“对抗—合作”“保护—惩罚”以及“震慑—吸引”的不同价值目标。对我国而言,应注重发挥阻断法的对外斗争功能,在比例原则和合理性原则的指引下,建立跨部门执法司法工作机制,建立、健全豁免例外制度,完善追偿诉讼机制,切实发挥阻断法的价值与作用,从而更好地回应我国当前反制裁、反干涉、反“长臂管辖”的战略需求。There have been four waves of legislation since the first blocking statute was adopted, and four core blocking measures are formed regarding the evidence, foreign measures,enforcement of foreign judgments, and compensation and relief. Foreign practice has shown that the implementation of these four blocking measures need to deal with the three pairs of relationships, including “the country enacting blocking statutes v. the blocked state”, “the country enacting blocking statutes v. its nationals”, and “ the country enacting blocking statutes v. nationals of the blocked state.” Accordingly, three pairs of conflicting interests would arise, which are “confrontation v. cooperation”, “protection v. punishment”, and “deterrence v. attraction.” In response to these challenges, the Chinese competent authority is urged to pay attention to blocking statutes’ function for legal battle and implement the blocking measures under the guidance of principles of proportionality and reasonableness. Specifically, the Chinese competent authority shall establish an intergovernmental law enforcement and judicial working mechanism, and at the same time, improve the exemption mechanism and the compensation mechanism. Only in this way, can we fully utilize the function and value of blocking statutes and better satisfy China’s strategic needs of counteracting foreign country’s sanctions, interference, and long arm jurisdiction.
