摘　　要：平台经济的迭代发展加速了金融资源的场景化流动,个人金融信息成为助推金融产品与服务升级的重要生产要素,针对依附于个人禀赋的金融信息争夺变得愈发激烈。在这一过程中,信息主体的有限理性令传统上个人信息保护的知情控制模式逐渐失灵,而金融业态创新的形势也要求维护信息安全的个人同意规范进行调整。从个体赋权向行为规制转变是改善个人金融信息保护困局的良善之策,通过引入“弱小圆点”分析框架,从法律、社群规范、市场、架构四个维度对信息处理者处理个人金融信息的行为进行引导与规制,有利于缓解当前个人金融信息保护的困局,也是《中华人民共和国个人信息保护法》出台后进行场景化适用的应有之义。The iterative development of platform economy speeds up the scene flow of financial resources. Personal financial information becomes an important factor of production to promote the upgrade of financial products and services, and the competition for financial information dependent on personal endowment becomes increasingly fierce. In this process, the limited rationality of the information subject makes the traditional informed control mode of personal information protection gradually fail, and the situation of financial industry innovation also requires individuals who maintain information security to agree to adjust the norms. Transformation from individual empowerment to behavior regulation is good to improve personal financial information protection dilemma. By introducing a “small dot”analysis framework, the information processor’s behavior of handling personal financial is guided and regulated from the four dimensions of law, social norms, market and organization. This is beneficial to alleviate the dilemma of the current personal financial information protection;and it is also the scene application as expected after the introduction of the Personal Information Protection Law of the People’s Republic of China.
