摘　　要：民国初年,大总统发布对前清法律有条件援用的命令。上海书业商会请求各省根据大总统令,保护书业各书商出版物的著作权。各省批词对于是否保护、如何保护并不一致,内务部发布《著作物呈请注册暂照前清著作权律分别核办通告文》,通告《大清著作权律》暂行援用,从而明确了《大清著作权律》在民国继续有效。In the early Republic of China, the President issued an order to conditionally invoke the law of previous Qing Dynasty.The Shanghai Book Industry Chamber of Commerce required all provinces to protect the copyright of the publications of books according to the order. As the instructions of the provinces were inconsistent as to whether to protect or how to protect, the Ministry of Internal Affairs promulgated the Public Announcement that the publications registration should be separately transacted temporarily according to the Law of Copyright of Qing Dynasty, declaring the invoking of the Law of Copyright of Qing Dynasty and clarifying the effectiveness of it in the Republic of China.
