摘　　要：在新媒体时代下,短视频行业繁荣发展,但同时也成为著作权侵权的重灾区,其根源主要在于有门可入、有器可用、有利可图、有空可钻。关于短视频著作权侵权认定的标准问题,理论界与司法界也存在独创性的认定标准、短视频作品的法律属性以及平台的法律责任等方面的争议。然而,短视频的著作权保护是一项系统的课题,需要完善法律监督机制、建立平台过滤机制、提高个人法律意识、提升科技赋能水平,以此构建“法制、平台、个人、技术”四位一体的社会治理模式,在人类命运共同体的理念下,追求各方利益的动态平衡,共同维护健康文明的网络环境,促进短视频行业的良性发展。In the era of new media,short video industry flourishes,but at the same time,it has become a disaster area of copyright infringement.Its root is mainly lies in low access threshold,convenient production and dissemination,huge business opportunities and infringement loopholes.As for the standard of short video copyright infringement determination,there are also disputes between the theoretical and judicial circles in terms of the originality standard,the legal attribute of short video works and the legal liability of platforms.However,the copyright protection of short video is a systematic subject,which requires improving legal supervision mechanism,establishing platform filtering mechanism,enhancing individual legal awareness and enhancing technology empowerment,so as to build a four-in-one social governance model of “legal system,platform,individual and technology”.Under the concept of a community with a shared future for mankind,the company pursues the dynamic balance of interests of all parties,jointly maintains a healthy and civilized network environment,and promotes the benign development of the short video industry.
