论搜索引擎服务商在电信网络诈骗犯罪治理中的法律责任

摘　　要：时下电信网络诈骗犯罪呈多发高发态势,并具有产业化、跨境性、受骗人数多,诈骗数额大等特点。利用搜索引擎推广诈骗网站、诈骗信息,以吸引不特定多数人落入诈骗圈套,是电信网络诈骗犯罪行为人惯用的诈骗手法。搜索引擎沦为电信网络诈骗犯罪的"帮凶",究其根本是搜索引擎的竞价排名规则为电信网络诈骗犯罪活动的实施打开方便之门。对于采取竞价排名经营模式的搜索引擎服务商,其所承担的注意义务应当区别于一般的网络服务提供者。这是因为提供广告推送服务的搜索引擎服务商不仅是网络服务提供者,同时还兼具广告发布者的身份属性。因此,对于在平台发布的广告信息,搜索引擎服务商所应承担的注意义务不只是一种事后管理义务,根据《广告法》的有关规定,其还应承担证件查验、内容核对等事前审查义务。Nowadays, telecommunications and network fraud crimes are showing a trend of multiple high incidence, and are characterized by industrialization, cross-border nature, a large number of deceived people, and a large amount of fraud crime. The use of search engines to promote fraudulent websites and fraudulent information in order to attract an unspecified majority of people to fall into the trap of fraud is a common fraudulent method used by telecommunication and network fraud criminals. Search engines have become the "accomplices" of telecommunication network fraud crimes. The fundamental reason is that the bidding ranking rules of search engines open the door for the implementation of telecommunication network fraud crimes. For search engine service providers adopting the business model of bidding rank, their duty of care should be different from that of general network service providers. This is because the search engine service provider that provides the advertisement push service is not only a network service provider, but also has the identity attribute of an advertisement publisher. Therefore, for the advertisement information published on the platform, the duty of care that the search engine service provider should undertake is not only a post-mortem management obligation. According to the relevant provisions of the "Advertising Law", it should also undertake pre-review obligations such as certificate inspection and content verification.
